Firefighters left woman in mine shaft for six hours due to ‘health and safety concerns’

An injured solicitor lay for six hours at the bottom of a disused mine shaft and eventually died of a heart attack because safety rules banned firefighters from rescuing her, an inquiry heard today.

A senior fire officer at the scene admitted that crews could only listen to Alison Hume’s cries for help, after she accidentally tumbled down the 60ft shaft, because regulations said their lifting equipment could not be used on members of the public.

A memo had been circulated around Strathclyde Fire and Rescue stations just four months before the tragedy in 2008 stating that the equipment was for use to bring up firefighters only.

Christopher Rooney, the first senior fire officer at the scene in Galston, Ayrshire, told the fatal accident inquiry at Kilmarnock Sheriff Court that it would have been possible to pull Ms Hume up if it had not been for the memo.

A paramedic volunteered to go down to treat the 44-year-old mother-of-two but was prevented from being lowered for the same reason.

The rescuers eventually called in a mountain rescue team, who freed the mother-of-two but she died after suffering a heart attack just as she was brought to the surface.

Mr Rooney, 51, who is now retired from the fire service, agreed with Gregor Forbes, representing Ms Hume’s family, that the restrictions placed on the crews that night prevented them from acting as they may otherwise have done.

He was asked: “On the basis of the manpower and equipment you had available, is it your view it would it would have been possible for the firefighters to have brought the person to the surface before the mountain rescue team?”

Mr Rooney, 51, replied: “Yes, I believe so.”

Mr Forbes said: “Your position is that, while you were supplied with safe working at height equipment, while this could be used to bring up firefighters, it could not be used to bring up a member of the public?”

Mr Rooney told the Kilmarnock Sheriff Court: “Yes, that’s correct.” All 18 firefighters at the scene were trained and capable of using the equipment, he added.

Ms Hume, a solicitor with the legal firm McCusker McElroy and Co, in Renfrewshire, had strayed off the path in a field near her home and fallen into former Goatfoot mine. For several hours she could be heard moaning from the bottom of the 60ft shaft but she grew quieter as she was finally brought out.

The inquiry was shown video footage of crews at the scene of the accident. Mr Rooney said he arrived at the scene at 2.30am but was hampered by darkness and mist reducing visibility in places to just 1m.

Ms Hume’s family led him to the 10m diameter hole which was partially concealed by bushes and long grass. “We heard Alison moaning and making distressed noises,” Mr Rooney added.

A fireman was lowered down with oxygen and first aid equipment but because of the safety rule could only wait with Alison until the mountain rescue team arrived.

Earlier, Hugh Cowan, Alison’s stepfather, said in a statement that the mountain rescuers seemed a more efficient service.

He said: “I want to know why the rescue effort took so long and we want to know why it took almost six hours to rescue her.”

Some advice then. If you find yourself in a scenario where “doing things by the book” strikes you as counter-productive and the accepted protocols and rules just don’t quite seem apt for the situation: fuck it. Grow a pair, cowboy up, accept that there are going to be consequences and do what you consider to be reasonable and right. It’ll cost you, certainly. There’s always some cunt with a clipboard who’ll make your life miserable because you’ve strayed outside the box they put you in. Frankly, they can get fucked as well.

Because here’s the thing: if you have the means to rescue someone, save a life, make a difference or improve the world in any way at all and the only thing that’s stopping you is a slip of paper from some twat in an office. Do it. Do it or take a length of rope and end it all right now because if you don’t, then you’re just another pleb making the world that little bit shitter than it needs to be and we can do without you.
